Terms of Service

1. Acceptance of Terms

By accessing or using the DocketView software (the "Service"), you ("Customer" or "you") agree to be bound by these Terms of Service (the "Terms"). These Terms constitute a legally binding agreement between you and DocketView ("we," "us," or "our"). If you do not agree to these Terms, do not access or use the Service. No Attorney-Client or co-counsel relationship is created by your use of the Service.

2. Description of Service

The Service provides access to publicly available documents filed in United States federal courts, served on parties in litigation via the CM/ECF system. We may update, modify, or discontinue features of the Service at any time, with or without notice to you. Because these are public records, we do not control the content or accuracy of the documents you access through the Service. We make no representations or warranties regarding the content or accuracy of the documents you access through the Service.

3. Account Registration and Use

To access and use certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

4. Fees and Payment

Access to and use of the Service may be subject to the payment of fees as described on our pricing page or as otherwise agreed upon. You agree to pay all applicable fees in accordance with the payment terms provided. We reserve the right to change our fees at any time upon notice to you. Unless otherwise stated, all fees are non-refundable.

5. Content

You may be able to upload, submit, store, send, or receive content through or cause content to be sent or delivered to the Service ("Content"). You agree that you will NOT upload, submit, or store any Content that contains information intended by you to be confidential or proprietary. You retain all rights in and to your Content. By uploading, submitting, storing, sending, or receiving or causing Content to be sent or delivered to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your Content solely for the purpose of providing and improving the Service. You represent and warrant that you have all necessary rights to grant us this license and that your Content does not violate any third-party rights. You are solely responsible for your Content and the consequences of posting or publishing it. Any Personally Identifiable Information ("PII") contained in your Content that was submitted to the CM/ECF system by you or others is your responsibility. DocketView is not responsible for any misuse, republication, or unauthorized access to such information. If we republish or retransmit your Content, we do so in reliance on your consent and the terms of our agreement with you and you agree to notify us immediately of any unauthorized publication or transmission of such PII so that we may take appropriate action to redact or remove such PII from our systems.

6. Acceptable Use Policy

You agree not to use the Service in a manner that:

We reserve the right to investigate and take appropriate action against any violation of this Acceptable Use Policy, including, without limitation, suspending or terminating your access to the Service.

7. Intellectual Property

The Service, including its design, structure, graphics, and code, is owned by or licensed to DocketView and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business purposes in accordance with these Terms. Except as expressly permitted in these Terms, you may not copy, modify, distribute, sell, or lease any part of the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOCKETVIEW, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless DocketView and its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Service; (b) your Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.

11. Termination

We may terminate or suspend your access to the Service at any time, with or without cause and without prior notice. Upon termination, your right to use the Service will immediately cease. Sections 5, 7, 9, 10, 12, 13 of these Terms will survive any termination.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or relating to these Terms or the Service shall be instituted exclusively in the state or federal courts located in San Diego County, California, and you irrevocably submit to the jurisdiction of such courts.

13. Entire Agreement

These Terms constitute the entire agreement between you and DocketView regarding the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will post the updated Terms on our website or through the Service and will indicate the date of the last update. Your continued use of the Service after the posting of revised Terms constitutes your acceptance of the changes.

15. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction. Notices to you may be made via email or by posting notices on the Service.
